GDPR and EU and U.K. Residents’ Privacy Rights

The EU and U.K. General Data Protection Regulations (collectively, “GDPR”) are privacy laws that afford certain rights relating to the Personal Data of individuals in the EU and U.K. which are discussed below.  For Personal Data subject to the GDPR that is collected through the Service, We act as a “controller.”

Lastly, if you are located in the EU or U.K. and have a concern about our processing of your Personal Data, You may have the right to complain to the appropriate Data Protection Authority in the EU or U.K. 

Data Transfers from the EU or U.K.

As indicated previously, your Personal Data may be transferred to our servers in the United States.  The United States has not received an “adequacy finding” from the European Commission under Article 45 of the GDPR.  We rely either on appropriate safeguards under Article 46 of the GDPR (specifically, standard data protection clauses approved by the European Commission) or on derogations for specific situations as set forth in Article 49.  For example, we collect and transfer Personal Data to the U.S. only with your consent, to perform a contract with you, or to fulfill a compelling legitimate interest that does not outweigh your rights or freedoms.  We endeavor to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with us and the practices described in this Policy.   We will enter into data processing agreements with our vendors when feasible and appropriate.

“Do Not Track” Policy as Required by California Online Privacy Protection Act (CalOPPA)

Our Service does not respond to Do Not Track signals.

California Privacy Rights for Minor Users (California Business and Professions Code Section 22581)

California Business and Professions Code section 22581 allow California residents under the age of 18 who are registered users of online sites, services or applications to request and obtain removal of content or information they have publicly posted.
